Turnover Proceeding

A turnover proceeding is a proceeding filed against an individual to return assets properly belonging to an Estate that were either transferred fraudulently or otherwise improperly. Some examples of turnover proceedings include:

  • An action to undo a deed transfer done prior to the death of the decedent under suspicious or improper circumstances;
  • An action to return funds improperly taken from a decedent’s bank account before or after death;
  • An action to return “gifts” made by the decedent before death under suspicious or improper circumstances;
  • An action to undo transactions improperly made by an agent of the decedent using a power of attorney before or after the decedent’s death.
