Mechanic’s Lien Foreclosure – $5,000 Retainer

Once a mechanic’s lien is properly filed, the lienholder has a limited amount of time to enforce the lien. A foreclosure action must be commenced before the mechanic’s lien expires. Enforcement takes play via a foreclosure action.

To initiate a foreclosure action, a summons and complaint must be filed and all proper parties served. The process is similar to a foreclosure that a lender would commence if a borrower stops paying his or her mortgage.

Once the foreclosure process is complete, the property will be sold and the proceeds used to pay the lienholder.

Our mechanic’s lien foreclosure attorneys will not only bring an action to foreclose the mechanic’s lien, but if applicable, will include other causes of action in the same lawsuit, such as:

  • Breach of Contract,
  • Violation of Trust Fund Provisions of Article 3-A of the lien law,
  • Violation of the New York Prompt Payment Act, and
  • Unjust Enrichment.

Our mechanic’s lien foreclosure attorneys require a $5,000 retainer to get started.
