Flat Rate Uncontested Estate Proceedings

In the state of New York, if the person was a NY resident or owned assets in NY, probate, a legal process that includes settlement of the estate and distribution of assets, is required.

The probate process may be contested or uncontested. Most contested matters in the probate process commonly result from dissatisfied heirs requesting a larger share of the deceased’s property than what was received

The probate process can be laborious, lengthy, and challenging, due to many legal and tax issues that may occur.

Uncontested probate proceedings can often times be very complex due to cases where assets are hard to collect, marriage, paternity, or other inheritance rights need to be proved, or with multi-generation estates where remaining heirs must probate several estates to get their inheritance.

At Levin Law Group, we have a lot of clients whose family members passed away and they need to transfer the assets of the deceased person. We decided to start handling estate administration to complement our real estate services, and so we can help our many clients who have this need.

Estate administration includes the legal services required in processing a person’s affairs after death. When a person dies intestate – which means without a proper will or living trust, a basic process of “creating” an estate with the courts is required, and the state laws will determine who will administer the estate, inherit the property, and take care of minor children, if any.

The estate administration process can typically consists of the following phases:

Initial Court Proceeding – probating the Will in the Surrogate’s Court, or if the person died without a Will, filing an “administration” proceeding in the Surrogate’s Court.

Basic Estate Administration – collection, inventory and valuation of assets; sale of decedent’s real estate and other assets; record keeping and computerization, raising cash requirements, payment of expenses, debts and legacies, filing of income tax returns, including fiduciary income tax returns, filing of Surrogate’s Court inventory.

Estate Tax Returns – preparation and filing of the Federal estate tax return; preparation and filing of the New York estate tax return; post-mortem estate planning, including disclaimers, renunciations; selection of a tax year for the estate; timing of distributions; QTIP elections, alternate valuations, excess deductions on termination; the generation skipping tax; preparing and handling of audits.

Accounting and Settlement – preparation of fiduciary’s accounting, judicial versus non-judicial accountings; final distributions of estate assets and payment of commissions; finalizing all aspects of the estate.
